Terms of Service

1. Acceptance of Terms

By creating an account or using the Pardesi mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Pardesi ("we," "us," or "our").

2. Eligibility

To use Pardesi, you must:

  • Be at least 18 years of age
  • Be legally able to enter into a binding contract
  • Not be prohibited from using the App under applicable law
  • Not have been previously removed or banned from the App
  • Not be a registered sex offender in any jurisdiction

By using the App, you represent and warrant that you meet all eligibility requirements.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, current, and complete information during registration and in your profile
  • Not create more than one account
  • Not share your account or let anyone else access it
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Harass, abuse, threaten, stalk, or intimidate other users
  • Post or transmit content that is defamatory, obscene, pornographic, violent, or otherwise objectionable
  • Impersonate any person or entity, or misrepresent your identity, age, or affiliation
  • Use the App for commercial purposes, advertising, or solicitation without our prior written consent
  • Upload viruses, malware, or any other harmful code
  • Attempt to gain unauthorized access to other users' accounts or our systems
  • Scrape, data-mine, or use automated means to access the App
  • Use the App to promote or facilitate prostitution, human trafficking, or any form of exploitation
  • Create fake profiles or use the App under false pretenses

5. User-Generated Content

5.1 Your Content

You retain ownership of the content you post on Pardesi, including photos, bio text, and messages. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating and improving the App.

5.2 Content Standards

All content you post must comply with these Terms. You must not upload:

  • Nudity or sexually explicit material
  • Content depicting minors
  • Violent or graphic content
  • Hate speech or content promoting discrimination
  • Content that infringes on the intellectual property rights of others
  • Spam or misleading content

5.3 Content Moderation

We reserve the right to review, remove, or disable access to any content that violates these Terms, without prior notice. We also reserve the right to take appropriate action against users who violate content standards, including account suspension or termination.

6. Safety and Reporting

Pardesi provides tools to report and block other users. You are encouraged to report any user who violates these Terms or makes you feel unsafe. We take all reports seriously and will investigate them promptly.

While we strive to create a safe environment, we cannot guarantee the conduct of other users. You are solely responsible for your interactions with other users, both online and offline. Exercise caution and good judgment.

7. Family First Feature

Pardesi offers an optional Family First feature that allows you to involve family members in the match approval process. By opting in:

  • You consent to sharing limited match information (name, age, city) with the family contacts you designate
  • You represent that you have the authority to provide the email addresses of your designated family contacts
  • You understand that family contacts will receive emails about your matches
  • You can opt out of this feature at any time

8. AI-Assisted Features

Pardesi uses artificial intelligence (Google Gemini) to assist with profile data extraction during onboarding. This AI processes your natural language responses to structure your profile information. All AI processing occurs on our servers, not on your device. AI outputs are used to populate your profile fields and may be reviewed and edited by you.

9. Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by Pardesi and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

10. Account Termination

10.1 By You

You may delete your account at any time through the App settings. Upon deletion, your profile and personal data will be removed in accordance with our Privacy Policy.

10.2 By Us

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise inappropriate. Grounds for termination include but are not limited to:

  • Violation of these Terms or our community guidelines
  • Reports from other users
  • Fraudulent or illegal activity
  • Extended inactivity

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF ANY INFORMATION PROVIDED BY OTHER USERS.

WE DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON USERS. WE MAKE NO REPRESENTATIONS OR WARRANTIES AS TO THE CHARACTER, INTEGRITY, OR INTENTIONS OF OTHER USERS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARDESI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless Pardesi, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in New York, New York, and the language of the arbitration shall be English.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

16. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will notify you through the App or by email. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes.
